[ issue - incomplete Scrabble game - Collectors edition ]
things just keep getting better. The seller hired a friend (let's call him George since that's his name) to arbitrate and help clear up the issue but that hasn't worked out too well. This guy asked me to send the item back but then the seller contacted me and told me NOT to send it back. Both PayPal and UPS have told me not to send the item back at this time. This morning I got a call from UPS who are investigating the issue. Unfortunately for the seller, I told the truth and that contradicts the story she gave UPS. I don't know but I am sure that UPS must then have got back in contact with the seller.

This afternoon I got an message to my eBay account from someone I don't recognize. Here's what is says:
hello,
e-mail the asshole and get the ladies name and number---you call her---she should be calling you--not him--you had the insurance on it not him--tell him you want the number of the charlotte ups lady
tell today not monday--you then tell him to send back the item to you today--he is lying and he is trying to get money back from ups
george
ps do that asap

Oh deary me, he seems to have sent the message to the wrong person. It sure as hell reads like it was meant to be sent to the seller. I reported the message to eBay, replied to his message (in a much more civil tone) and also forwarded the message onto the rightful recipient (the seller).

Think I can sue this idiot?

I know, it sounds so simple.

It's not over a single missing piece though, it's over 8 missing pieces (and 7 extra ones). I know it all seems very trivial but it was a costly set. Wooden board, gold plated tiles, etc.

This whole thing would have been over a long time ago if the seller had just said, "OK, sorry, here's a refund and please send the item back."

It's a different story now though.

I guess that whats you get for buying the blinged out dork edition of Scrabble

Has eBay suspended the account or anything? I don't understand why UPS is in on the deal, even if the item was insured. If it was shipped incomplete from the get go, UPS has shit to say.

The obvious thing to do is wait for a refund before sending it back. I'd almost stopped e-mailing the person until eBay contacts them or something. Sounds like a real winner you have on your hands.

Just to somewhat explain my idiocy .....

The reason I chose to buy the collectors edition is because my wife and I play Scrabble a lot and it was recently our 5th wedding anniversary (which is wood). It seemed appropriate.

The seller was contacting UPS because she thinks the issue is over 1 missing tile and she thinks UPS is to blame for losing the tile. But there are 8 missing tiles and 7 extra tiles. I think it's obvious that UPS are not to blame for that mixup. I told all that to UPS and they said that was a different story than what the seller was saying. I could fake the missing tiles easily enough but it's more difficult to fake extra tiles (unless you have the odd collector's edition just lying around).

As far as not contacting her again. I think I will but I will be as nice as pie. I'm not going to lower myself to her friend's level. Why give them ammunition to use against me? I have all the messages stored...just in case.

You've shamed me into admitting that I indeed spent a large sum of money on a game of Scrabble. My only defence is that it's a collector's edition.

However, assuming I get my money back, I probably won't do the same thing again. I'm going to make my own. I've already had a dry run at getting the board / grid done on my table saw and I don't think it will be too hard.

If you do get refunded and send it back, I would make sure to get a signature confirming delivery. Then lets see what she says is missing.
Hope you get it straightened out sooner or later. What kind of feedback does this seller have?

I got my money back.

Yay.

However, the seller said to me in a previous e-mail that she would cover return shipping and insurance. Now she is not doing so. I have copies of all the correspondence. She lives in North Carolina, I live in Mass. If I want my $63.30 back then I need to go to the Small Claims court but after everything I have read that sounds like I would need to travel to North Carolina which would cost me a damn site more than $63.30. If I could be sure that I would get all travelling expenses paid for as well then I would consider doing it but it could turn out expensive if (1) I lose, or (2) I win but only get back the shipping money.

Does anyone know enough about the small claims court to know if I could file locally and make her come up to Mass to defend herself?

I know I should just let this go now but 60 bucks is a lot of money just to throw away like that, especially after I was told I would be getting it back!

Eat it. Be glad you got your money back from the board game itself. Sounds like you're dealing with a bitch so I'd consider myself lucky. File with eBay again, see if you can get her account suspended/deleted.

I just found a great resource, online, that allows you to speak with a law librarian (not an actual lawyer). According to Mass law, the claim can be filed in the plaintiff's or the defendant's county. I think I am going to send my letter asking for a friendly resolution but finishing up with something that basically says I have no problem dragging her ass up to Mass to see her in the small claims court. I don't have to follow through with it but perhaps the threat of such an ordeal will be enough to make her pay. I presume she doesn't want a court judgement on her record, she's a pretty big seller on eBay.

This is why eBay is horrible. My dad sells tons of stuff on eBay and has to deal with knuckleheads all the time. Sorry you ran into a bad seller Max.
